weapons ban and strengthening penalties on gun traffickers. >> they're are common sense members. they have the support of the majority of the american people. yet that doesn't mean any of this will be easy to enact or impleme implement. if it were we would already have it. the high capacity magazines never would have been allowed to expire. more of our fellow americans might still be alive celebrating birthdays and anniversaries and graduations. >> the president also signed 23 executive orders immediately following his remarks. they include tougher penalties for people who rely on background checks for the government to research and providing incentives for schools to hire school resource officers. as the president anticipated, his critics started slamming proposals. the republican senator marco rubio saying nothing the president is proposing would have stopped the massacre at

sandy hook. he is targeting the rights of law-abiding citizens instead of addressing the real underlying causes of such violence. add this tote pot. the congressman from kansas said taking away the rights and abilities of law-abiding citizens to defend themselves is another display of the administration's consolidation of power. joining me now from connecticut is john larson. thank you so much for joining me, sir. let me get your initial reaction to what you heard from the president. is it what you were hoping for? >> absolutely. i was fortunate to fly up from the president from d.c. to newtown when he gave his address. i can you to his marrow he was impacted by this and said it was the worst day of his presidency and he was resolved to do something about it and he has. i think the nation is behind

this president and it is different now. i think the road ahead may be difficult, legislators shouldn't be afraid to stand in the way. the teachers weren't afraid to stand in the way of that massacre. that principal was not afraid to stand in the way. we have to get behind the president. nothing he is proposing, he is not taking guns away. everything he is proposing is common sense and practical and comprehensive and including mental health and school safety provisions. the second amendment that everybody abides by and believes in, it calls for a well-regulated militia. let us get out the regulations. >> the president said it and many of us echoed the same thing. life changed and it was a responsibility of all of us to reflect after new and even what

we see in chicago. the r and c chair said this. they have power grab. marco rubio said that president obama is making matters worse and abuse his power by imposing policies via executive rather than allowing power for congress to debate this. senator mike from nebraska, a republican said the president is placesing a heavier burden on gun owners and it will do little from preventing violent acts. can you name me one republican since new town n your opinion that you had a conversation with who has change and would support an assault weapons ban today given what we have seen and heard from the victims of newtown, aurora, oregon and the list goes on and on. one republican who has changed since then. >> i would be hard pressed,

tamron, but i believe that there has been a change. as the president went on to say and i believe this to be true. change doesn't happen in washington, d.c. change happens back home. it's going to be the mothers and the parents and hunters and members within the nra and veterans returning home who understand the impact of assault rifles and high capacity clips. this is going to bring about the change. i believe enough in my republican colleagues, i watched so many of them endure their own conferences not to provide relief for sandy yesterday. i see this change that is coming and it's slow and gradual and the president said don't underestimate the power of the gun lobby in washington, d.c. these are common sense, practical solutions. members have to be unafraid to stand in the way as john lewis

would say. >> thank you. i greatly appreciate your time. are the me bring in our panel, tim murphy and senior political reporter for politico and michael smerconish, a radio talk show host. let me start with you. there is an article today that said why president obama's gun plan may be doomed and said there strong indications that comprehensive legislation won't even see a vote on the house flew. you heard me. wasn't to put him on the pot, but i watched like you since new town and people said things have changed. i have yet to see and maybe you know of a few republican who is said things have changed and maybe it is time to put a man on assault weapons or some of the language ta is different than what we are hearing accusing the president of tyranny a power grab and the other accusations. >> let's separate two things.

first of all, if you watch that press conference, a good solid one third was a direct appeal to the american people. he repeated himself over and over again. you heard congressman larson on the talking points and common sense. this is only going to happen if the american people want it to happen. you are going to see i think the president is prepared to use capital on this. you will see maybe a grass roots effort. maybe his vast database to try to get pressure on the republicans. i'm not ready to quite write it off although there a lot of other things coming up and so much you can do in a session. as far as the republicans talking about the power grab, that's very different from his proposals. he23 consecutive orders and none of them have teeth. they are saying look over there. all he is saying is let's get more research done about video

cams and more information about health care providers. that's a big draistraction that the republicans are launching. >> i don't want to give up on anyone, but after newtown, it was joe scarborough that pointed out he tried to get on a number of republicans on the show and wanted to wait until the nra had responded. joe, again, a friend of many conservatives in washington and i have not seen a laundry list saying it is time to we look at xyz. there is a push back. i want to play what president obama said regarding what lois pointed on. this movement from the people that we may see. >> ask your member of congress if they support universal background checks to keep guns out of the wrong hands. ask them if they support renewing a ban on assault weapons and high capacity

magazines f. they say no, ask them why not. ask them what's more important. doing whatever it takes to get an a grade from the gun lobby that funds their campaigns or giving parents some peace of mind when they drop their child off for first grade. >> you have the president saying ask some of the members of congress. today we have a laundry list of representatives who would say no as the president posed a ban on assault weapons. no to a ban on the high capacity magazine clips. if you ask why, they would say it's our second amendment right to own these things. those are the solid answers we have to that question the president posed. >> the white house knew that before the president stood up with president biden and they could have decided to go short instead of go big. they ended up going big.

i'm glad they did because this conversation is long overdue and the president was both common sense cal and realistic. he said to the american people i am not getting this done unless you become an activist in the community and ask your number of congress where they stand on these things. i think he is paying no attention to the vilification from the right that existed from day one even though the brady folks give him an f for the first year in office. the glen becks of the world is saying he is coming for your ammo. there was nothing to back it up. there is still nothing to back it up. >> you had a great article on mother jones, things you felt the president could do immediately and named an atf director. it has been years and it's time to make that appointment. i want to go back to the people who end up voting. the congressman from texas

talking impuchment. i will play his remarks. >> we want all tools available to use including that impeachment. you are using children. it reminds me of saddam hussein. >> reminds me of saddam hussein when he used kids having children writing letters to them. picking up on it, it is right to have optimism. i hope that's a part of our nature. how do you go into a debate with optimism when you have a person elected with constituents in my home state of texas who said the president is using children as a human shield and talking about impeachment rather than the solid ideas before all of us. >> president obama was never going to win them over. what was interesting about today is how sort of loaded they were with ideas that were proposed by

ideas like la pierre who called for a mental health database. they provide carrots to have federal agencies do a better job providing for mental health information to go into the background system. there is a lot of lower hanging fruit in the ideas he put forward that could have bipartisan support. >> pointing out the background checks, i think the odds are according to a couple of blocks, about 75%, they see it below 50% to get the assault weapons passed of any kind. at least some movement if possible on a few of those ideas. here we are the day before the president made this announcement of what to expect with executive action and the laws he would want congress to pursue. you have this nra ad that is

going after the president's daughters in an inappropriate matter. this came before the president's remarks today. the president's kids more important than yours? why is he skeptical about putting armed security in our schools when his kids are protected by armed guards at their school? >> the nra said whoever thinks this ad is about his daughters are missing the point. they are trying to change the subject. this ad is about keeping your children safe. the white house has responded saying this ad is terrible and an awful ad. what is your take on that being a part of the preview strategy going in before the president's detailed remarks today? >> i was kind of surprised by it. there has been an unwritten rule that the president's kids are off limits. i wasn't sure where the nra was going because it seems they are going to get a lot of push back.

of course it was about the president's kids. he mentioned the president's kids. presidents have always gotten secret service. they also got into name calling, calling the president an elitist hypocrite. it went for the jugular, this ad. >> i could be wrong and you know of a few republican who is came out and said i'm a member of the nra, but this is crossing the line. >> i haven't seen any. that doesn't mean there haven't been any. joe scarborough whoefs a former congressman came out against it. i haven't seen any congress men. i think they are afraid of the nra. they are concerned about their weighting and they don't want the nra turning on them. >> i appreciate all of your voices in this conversation. thank you. up next, more reaction to the president's new gun proposal. i will talk to john rosenthal

many of the remarks we heard from, critics of the president mentioned the second amendment, r why nc's chair said it amounts to eye power grab and he paid lip service to the constitutional right, but took actions that disregard the second amendment and legislative process. you are the professor. constitutional law. what you heard today, does that amount to the president paying lip service to the constitution? and the rights of those who own guns? >> no. the supreme court is the final arbitor on what the second amendment protects. in the helder case of 2008, the master case on this whole thing that the second amendment protects people's rights to keep the sort of weapons used in colonial days or weapons analogous to that. they went out of their way to

say in the opinion that assault weapons could be banned and that automatic weapons could be ban and mentally ill people should not get weapons and there would be back ground checks. there could be a range of reasonable restrictions that would not infringe on people's second amendment rights to have weapons. >> let me ask you this remark from senator marco rubio who said the president is targeting the second amendment rights instead of addressing the underlying causes. back to the question. you explain the law and what's on the books here. is there anything in what you heard that would curtail the second amendment rights of law-abiding citizens as alleged by senator rubio? >> i don't think so. people use it loosely. they mean gun rights that we think people should have and

they talk about the second amendment encompassing rights that they think are desirable for people to have. it's loose language. admittedly if the legislative proposals were put into effect in a blunder bust way and not carefully crafted, there is a point at which they might be too draconian and restrictive that could infringe the second amendment and nothing about the proposals and either his legislative proposals or executive orders he is talking about and nothing in those in any way conflicts with the second amendment that the supreme court defined definitively. it was a limited decision. >> talking about the issue of the second amendments or the concerns or words he knew would come following his remarks. let's play it. >> i respect our strong tradition of gun ownership and

the rights of hunters and sports men. most gun owners agree that we can respect the second amendment while keeping an irresponsible law breaking few from inflicting harm on a massive scale. >> they told "time" magazine they for the first time have money and coordination that they did not have before. they see this as the best shot that they are taking coming at us referring to people like yourself who are advocates for gun laws and a ban on some of these assault-style rifles. he said that you see it as the best chance and you are coming for them. >> well, i'm one of those law-abiding gun owner who believes in a second amendment and believe that is the founders never intended the second amendment to extend to the mentally ill and even al qaeda and terrorist who is come to the united states to 33 states and thousands of annual gun shows

where they can buy military-style weapons easier in our country than theirs without an id or background check. i was proud of the president today and also incredibly sad. think about those 20 beautiful kids who are now like a political football killed with a military-style weapon and high capacity ammunition clip made for war. the president is trying to save other kids's lives and since newtown, 900 more americans have died from gun violence and guys like rubio and the republicans and even democrats are saying he is trying to take the second amendment away? he is trying to save lives without banning most guns. the only one he is talking about banning are military style weapons. we have seen how broken the congress is. on the gun issue, it's or did

you mock reas is dying. no way that are going to pass congress in the existing congress because our congress people, a majority in congress are more concerned about the unregulated tens of millions of dollars that come from the unregulated gun industry and the nra than public health and safety. >> if that's the case what would give people like yourself any hope? if you believe that here's a congress that went through this issue with for example, getting relief to victims of hurricane sandy, we see what happens with fiscal issues. is this perhaps one of those issues that fall into id ideological differences. they say this is tyranny power grab, what gives you hope that things really changed regarding gun legislation since newtown?

>> because tamron, this is the soft, ugly underbelly of us losing democracy to special interest. if the american people seant see it in living color, that congress doesn't care about 20 beautiful babies killed in elementary school and 900 americans killed since, 3,000 americans every month? that's the equivalent of a 911 attack a month from gun violence. if they don't jam the capitol switch board, we deserve what we get. this issue could help change congress in two years. this issue i really hope the gun lobby tries to impeach our president. that may be the only thing that keeps this public health crisis that kills 87 americans a day, it might keep it alive until we can beat the spineless congress

because you are there in a gun shop talking to people who have spoken about in the abstract. you see the numbers ofphobes who are supposedly barely able to walk out of the door because they are loading up. no pun intended. what are you hearing in regards to what the president said today? >> this is blue ridge, a known gun shop. it is down the road from the national headquarters of the national rifle association. to that point, the president was on a big screen and we watched the announcement and whatever. the folks were too busy. there were a lot of customers in the store at that hour. the employees and the managers tell us since sandy hook, they had a boom in sales specifically in the automatic rifles and the assault-style weapons and an interest in the and it's almost a panic setting in.

customers worriyed and trying to buy what they think might be banned. business is booming and a lot of cases the phones are ringing off the hook. >> i'm out of a job and business is good for me. that i have a job, but i am selling so much that they have nothing to buy right now. >> to that point, we did check in by the way to see what's happening with the stocks and the major gun manufacturers about smith and wesson and both initially jumped about 4% while the president was making the announcement. gun retailers are up 5.9%. those are huge jumps. one day on a historic day following the president's announcement. here at a typical gun shop, if you will, it's all about trying to buy what we may not have or have access to in the future.

>> thank you. now let me bring in sandra levin, a democrat from wisconsin. i'm not sure you heard him, but he was at a gun shop in virginia saying that people were not listening to the president's proposals today. their priority was to load up and purchase these weapons they believe will be banned. what is your reaction. the president even said it will be whipped up by pundits and want ratings to get these folks afraid. >> i think everybody should be concentrated on what the president said. whether we need to take action. that's the obligation of every citizen. the president said we will protect the second amendment, but we have to protect our children. we have to protect against violence. you know, i was just at a

hearing and i think newtown was a seminole event that changed the ground on which this issue is walking. in a sense what every family is doing is saying what if it were one of our family members who was killed at newtown? we are personalizing it. i think at long last there will be action in this town. >> you say we are personalizing this or many people are personalizing and thinking about the debate as they see it. they are focusing in on the president's daughters, sasha and melee in the ad saying they have security at their school so why shouldn't the children of other americans? let me get your reaction to that. the white house obviously coming out against it. what is your thought there?

>> i just saw a bit of that ad and i think it's terribly mistaken. the president's children are in a different category in one sense, but the real issue is whether all the children of this country will be safeguarded. i think that means some resources in the schools, but it means way beyond it. there is violence beyond the schools on street corners everywhere. what we are doing is saying what if it were a family member? that permanentization is very, very legitimate and makes newtown a seminole event. i think the ground is changing. >> the nra if the ground is changing, it may be dividing democrats and the nra and gun rights folks and gun control advocates even more. the nra said attacking firearms and ignoring children is not a

solution to the crisis we face as a nation. only honest law-abiding gun owners will be affected and our children will remain vulnerable to the inevitable tragedies that we face. basically they are saying they are looking out for the children by wanting armed police officers or armed security guards at the schools here. i bring up the nra. they spent over $20 million in the last decade on lobbying people that you have to deal with on a daily basis, our lawmakers. if the lawmakers that you are kmu behind the scenes are are taking queues from the nra, what will make the american people believe if the ground is moving these two sides together? >> the nra has it 180 degrees wrong. we are not going to harm the needs and the aspirations of the legitimate gun owner.

we are not going to do that at all. unlike what they are suggesting, we are going to protect the children of america. they have it 180 degrees from the truth. we are not going to affect -- >> which do you think will pass. i know you said a 50-50 chance that an assault weapons ban will be put in place. what do you believe will passing through congress? >> i think magazines and assault weapons will pass. i think background checks will pass. i think there will be more resources for people. i think we will address mental health. what we will do is do this in a comprehensive way and not let one aspect divide us from another. it's time. i have been looking at this issue for so many decades and there have been so many false starts. people have been essentially frightened by the misconceptions and the misat the same times of the nra.
